NY boat victims' parents doubt booze caused crash

PIERMONT, N.Y. (AP) ? The parents of the bride-to-be and best man killed in a New York boating accident say they're skeptical that alcohol caused the crash.

They also said in a statement Wednesday that survivors told them none of the six people on the boat saw the barge they crashed into Friday night on the Hudson River.

Investigators have said they are looking into whether the barge was properly lighted. The Coast Guard says it was.

The crash killed Lindsey Stewart, who was to be married Aug. 10. It also killed her fiance's best man, Mark Lennon.

The groom-to-be and three other passengers were injured, including the boat's operator, Jojo John. Police say they suspect John was intoxicated and he has been charged with vehicular homicide.

His lawyer calls the crash "a tragedy."

The stepfather of a bride-to-be killed in a boating accident on the Hudson River said no one aboard saw the construction barge near the Tappan Zee Bridge before crashing into it.

Walter Kosik said he spoke to his daughter's fiance, Brian Bond, who told him all six people on the powerboat had their eyes on the river, but no one saw the barge's dim lights.

"What we want to talk about is the lighting on the barges," Kosik told The Journal News (http://lohud.us/1ckOoOe). "You've got two anchor lights, one on each side of the barge. With the glare off the bridge, you can't see it."

He continued: "It's just amazing that, the following day, (Gov. Andrew) Cuomo put lights on those barges, lighting it up like a Christmas tree 24 hours from when they got killed."

The New York State Thruway Authority has said that the barge lighting appeared to be functioning normally, but it remained part of the investigation.

The extra lights were added "because we wanted to go above and beyond to try and prevent something like this from happening again," spokesman Dan Weiller said.

Bond was to marry Lindsey Stewart on Aug. 10; his best man, Mark Lennon, also died. Both were 30. Bond and the three other people were injured.

Bond told Kosik that they all had about one alcoholic beverage each before Friday's crash. Boat operator Jojo John had a few drinks, Kosik said, adding, "If he was that drunk, they would not have gotten onto the boat."

John was charged with vehicular homicide in Stewart's death. He hasn't been charged in connection with Lennon's death. His lawyer called the crash "a tragedy for all of us."

The Journal on Wednesday identified the remaining two survivors as John Schumacher, 44, and Daniel Dilorgi, 28, both of Valley Cottage.

Dilorgi was recovering at home. Schumacher was in surgery Tuesday, according to his lawyer, John Pappalardo.

A funeral service for Stewart was scheduled for Thursday at Good Shepherd Lutheran Church in Pear River, where she was to have been wed. Lennon's funeral was set for Friday at St. John the Baptist Church in Piermont.

John Boehner Needs to Do More Than Stand In Front of a Wall with a Hashtag for Jobs

On Wednesday, Speaker Boehner (R-OH) accused President Obama of threatening to shut down the government. Yes, the Speaker said today at his presser, ?Instead of working together, the president yesterday threatened to shut down the government and recycled some of his old partisan proposals.?

Watch here and try not to laugh thinking about just who is recycling 40 votes to repeal ObamaCare (their own idea):

?Under the president?s leadership our economy continues to struggle with slow economic growth, high unemployment, stagnant wages. And frankly, I think we can do much better.

?Instead of working together, the president yesterday threatened to shut down the government and recycled some of his old partisan proposals. His scheme yesterday would actually require small businesses to pay higher tax rates than big companies. Now the only thing that?s new here is that he wants to take some of that revenue and use it for more of his ?stimulus? spending.

?Listen, Republicans are acting on economic growth & job creation. This week, we?ll work on a permanent, market-based rate for student loans. It?s very similar to a bill that we moved here in May. I want to congratulate the Senate for finally getting this bill over to us. We?ll pass bills to stop government abuse. And we?re going to continue to work on real tax reform, both on the personal side and the corporate side, not just to help big companies.

?We?re not just over here making noise, the House Republicans are continuing to take action.?

Boehner is still pretending the Keystone Pipeline (from which he stands to benefit financially) is a JOBS BILL. The Speaker seems to believe that if he stands in front of a press wall with the hashtag #4jobs, people won?t know any better. That explains why he claimed that Republicans aren?t just talking about jobs, they?re taking action.

Boehner?s pressers have become highly uncomfortable to watch as he tries to avoid falling headfirst into the tea quicksand of fail.

The House didn?t manage to do much else other than 40 fake show votes to repeal ObamaCare (aka, free campaign ads for Republicans) during this year?s session. They even failed to live up to their own budget. To avoid discussing these realities, Speaker Boehner has taken to pretending like he?s not in charge.

As cover, Boehner never appears without a prop that has the word JOBS on it, even though his House has not actually tried to do one thing about jobs except block President Obama?s jobs bills. The propaganda efforts are getting desperate for this one; Speaker Boehner #4Jobs is as fictional as the scandals his House invents.

As House Republicans exit stage Right for their ?recess?, Americans are wondering where are the jobs, why is sequestration still in place, why can?t Republicans even sit down at the table for budget reconciliation, why did they only manage to pass 4 appropriations bills out of 12, and most of all, why are they even coming back?

Republicans are coming back so that they can hold our economy hostage in order to take healthcare away from the rest of America. They got theirs. What?s your problem? #4Jobs!

Publicans want ?lid levy? to replace losses from alcohol sports sponsorship ban

A LEVY ON off-licence sales would raise money to bridge the funding gap created by the loss of alcohol companies? sponsorship of sports, the Vintners? Federation of Ireland claims.

The VFI, which represents over 4,00 publicans outside of Dublin has reiterated its call for a so-called ?lid levy? ? a charge on all unopened alcohol products sold in the off-trade ? to generate funds lost as a result of any ban on drinks companies sponsoring sports.

It was reported at the weekend that ministers have struck a compromise deal on ending alcohol sponsorship of sports by 2020 although significant hurdles remain with regards to how to replace funding of some ?20 million that sporting organisations currently benefit from.

The VFI claims its idea of a 15 per cent tax on alcohol sold in off-licences would raise about ?240 million and ?protect the employment intensive on-trade sector and 50,000 associated jobs while generating badly needed revenue for sports and other areas?.

However, the National Off-Licence Association has previously said such a measure would put the independent off-licence sector out of business overnight with already thousands of job losses in the off-trade sector since the recession hit.

?We are unashamedly saying that this ?lid levy? proposal will help protect the labour intensive on-trade,? Gerry Rafter, president of the VFI, said.

?We know the government needs to generate income so we are giving them a solution that raises the necessary revenue and could fill a vacuum left by a ban on alcohol sponsorship while protecting jobs at the same time.?

Earlier this month an all-party Oireachtas Committee rejected proposals to ban alcohol companies from sponsoring sports events and organisations instead recommending, amongst a number of measures, the use of funding for substance abuse programmes.

An agreement at Cabinet level would only be only likely once ministers have put in place ways in which to make up the likely funding shortfall left by banning alcohol companies from sponsoring sports.

EU'S Ashton holds two-hour talks with ousted Egypt leader Mursi

DUBAI (Reuters) - European Union foreign policy chief Catherine Ashton met ousted Egyptian president Mohamed Mursi late on Monday and held two hours of "in depth" discussions, Ashton's spokesperson said.

Spokesperson Maja Kocijancic said on her Twitter account that the meeting had taken place, but did not say where.

Mursi has been in detention since he was ousted after the military-backed interim government placed the deposed Islamist under investigation on charges that include murder.

Ashton is on her second visit to Cairo in 12 days as one of the few outsiders able to speak to both sides in Egypt's political crisis. She is expected to speak to reporters later on Tuesday.

On Monday, Ashton met General Abdel Fattah al-Sisi, the head of the army and the man behind Mursi's overthrow. She also held talks with members of the interim government installed by the army, and representatives of the Freedom and Justice Party, the Brotherhood's political wing.

Before arriving, she said she would press for a "fully inclusive transition process, taking in all political groups, including the Muslim Brotherhood".

The EU has attempted to mediate in the political crisis over the past six months as Egyptians have grown increasingly suspicious of U.S. involvement. President Barack Obama delayed delivery last week of four F-16 fighter jets to Egypt, in a gesture of displeasure at the turn of events.

Pfizer to pay $491M to resolve drug marketing case

The U.S. Justice Department said Tuesday that drugmaker Pfizer Inc. will pay almost $491 million to resolve an investigation into illegal marketing of the organ transplant drug Rapamune by a company Pfizer later acquired.

Pfizer, the world's second-biggest drugmaker, had taken a charge to cover the settlement late last year, when it reached a tentative settlement to resolve lawsuits three whistleblowers had filed back in 2005 and 2007. The Justice Department and numerous other government agencies eventually joined in the probe and the lawsuits.

On Tuesday, New York-based Pfizer agreed to pay $257.4 million in civil settlements with federal and state governments and a $157.6 million criminal fine. Pfizer also will forfeit $76 million in assets.

The Justice Department said the drugmaker Wyeth, which Pfizer bought in October 2009, trained sales representatives to encourage doctors to prescribe Rapamune for uses other than preventing rejection of transplanted kidneys, even giving them bonuses for doing so.

Rapamune was approved in 1999, only for use in kidney transplant patients. Federal laws bar drugmakers from promoting drugs for uses not specifically approved by the Food and Drug Administration.

But the practice has previously been so rampant that there's a term for it ? off-label marketing ? and multiple law firms specialize in pursuing lawsuits over it. Nearly every big drugmaker, including Pfizer, has been prosecuted for it and eventually agreed to big settlements with the government and whistleblowers, who usually are drug store pharmacists or former pharmaceutical sales reps. The record settlement is $3 billion, paid by British drugmaker GlaxoSmithKline PLC.

In the Rapamune case, whistleblower Mark Campbell, a Wyeth sales rep for 20 years until he resigned in 2009, alleged Wyeth promoted Rapamune for patients getting liver, lung, heart and other transplants ? potentially dangerous uses.

"I believe this settlement represents at least a small step towards insuring that pharmaceuticals are promoted in a manner which does not compromise patient safety," Campbell said in a statement.

Pfizer said In a statement that it "was not a subject or target of this matter, and cooperated fully with the government from the time it learned of this investigation in October 2009. That cooperation was acknowledged today by the Justice Department."

Campbell's lead attorney, Shelley Slade of Vogel, Slade & Goldstein, said the federal and state governments splitting the settlement from Wyeth are still working out how much of that money will go to the three whistleblowers, who worked together on the case. The other two, Marlene Sandler and Scott Paris, were represented by another law firm.

Pfizer shares fell 13 cents to $29.67 in trading Tuesday.

Florida School Textbook Praises Islam, Denigrates Christianity

A world history book used in an Advanced Placement class is under review by a Florida school board over allegations it favors Islam at the expense of Christianity and Judaism.State Rep. Ritch Workman told Fox News the Prentice World History textbook rewrites Islamic history and presents a biased version of the Muslim faith.

?The book has a 36-page chapter on Islam but no chapters on Christianity or Judaism,? Workman said. ?It?s remarkably one-sided.?

The textbook is being used in an Advanced Placement class in Brevard County schools. The book is on a state-approved list and has been used in the school system for the past three years without any complaints.

Workman said he received a copy of the book and he said it?s clear the authors ?make a very obvious attempt not to insult Islam by reshaping history.?

?If you don?t see it from the eyes of a parent, kids are going to take this book as gospel and believe that Christians and Jews were murderous barbarians and thank God the Muslims came along and the world is great,? he said.

For example, Workman said a reference to Mohammed and his armies taking over Medina states, ?people happily accepted Islam as their way of life.?

?It leaves out that tens of thousands of Jews and non-believers were massacred by Mohammed?s armies,? he said. ?It?s a blatant deception.?

The book indicates that Jesus proclaimed himself to be the Messiah while stating as fact that Mohammed is a prophet, Workman said. Students are also given lessons on the Koran and the five pillars of Islam. The

?They don?t do that for Christianity,? he said. ?That is offensive to me.?

School board member Amy Kneessy told Fox News she has similar concerns.

?Some of the descriptions of the battles use the word ?massacre? when it?s a Christian battle and ?takeover? when it?s a Muslim battle,? she said. ?In young minds, massacre paints a very different visual picture than a takeover or occupation ? when in fact both battles were very bloody.?

Kneessy said she?s also concerned that the book devotes an entire chapter to Islam.

?I don?t want revisionist history,? she said. ?History is history.?

Pearson, the publisher of the textbook, confirmed there is a chapter titled, ?Muslim Civilizations.?

?Pearson and its authors adhere to the highest editorial standards when creating course materials, which undergo a rigorous review process,? Pearson spokeswoman Susan Aspey told Fox News. ?A review of the book shows there is balanced attention given to the beliefs of Islam, Judaism and Christianity.?

However, Workman said that statement is ?patently unfair and untrue.?

?They hired a Muslim cleric to write the Muslim section,? he said. ?The publisher told me.?

Aspey said that?s not correct.

She said ?academic experts did review the content, but they did not write it or edit it.?

Ten charts: Why Wall Street loves Amazon and hates Apple

chart_ws_stock_appleinc_201372934043_240xa FORTUNE -- In November, the last time we compared Apple's (AAPL) and Amazon's (AMZN)?price-to-earnings ratios -- the simplest and most widely used metric to gauge the relative ?value of a pair of stocks -- ?Apple's trailing PE was 13 and Amazon's was 2,767.

We haven't been able to repeat the exercise because while Apple PE has drifted with its stock price to between 10 and 11, Amazon's trailing PE has reached, as Buzz Lightyear might put it, infinity and beyond. (Or, as the stock charts politely have it, NA.)

That's because Amazon, which reported its June earnings on Friday, hasn't turned a profit for three quarters in a row -- a performance that Wall Street rewarded by pushing its stock to an all-time-high of $312.01.

It will come as no surprise to readers here that Apple, which posted record fiscal Q3 sales (but lower earnings) three days earlier, couldn't catch more than a one-day break on the stock market.

That's because as far as Wall Street is concerned, Apple and Amazon are in completely different businesses. As a regular on Investor Village's AAPL Sanity board put it last week:

"The Street sees Amazon as the world's biggest (online) global retailer with almost limitless growth.?[It] sees Apple as a (mobile) device maker that because it is wholly dependent on its ability to innovate nonstop, expand its (ultimately saturated) markets while fighting off competition and controlling its very unstable supply chain, has limited growth."

College Baseball: Dix heads to Francis Marion program

Former Graham baseball player Cody Dix is part of the recruiting class at Division II Francis Marion as a transfer.

The school announced that Dix is one of 10 transfers into the program for the 2014 season.

Dix, a left-handed pitcher, has two years of eligibility remaining after spending the 2013 season at Southeastern Community College in Whiteville. He posted a 6-5 record with 1.68 earned run average for Southeastern Community College.

In 2012, Dix was with the UNC Pembroke program.

Pitcher Eric DuBose of Lexington, S.C., also is headed to Francis Marion out of Southeastern Community College.

BARCELONA, Spain (AP) ? When Michael Phelps walked away from swimming after the London Olympics, he was adamant about one thing: His career was over.

Now, it sounds like he's not so sure.

While saying he's never been happier with his life ? and certainly doesn't miss the grind of what it took to become the most decorated Olympic athlete ? Phelps left the door open to change his mind before the 2016 Rio Games.

"I don't know what's going to happen in the future," Phelps said Monday. "I don't know what's going to happen tomorrow."

In Barcelona for the world swimming championships, Phelps spoke to The Associated Press and other international media organizations in a series of one-on-one interviews set up by his sponsor, Speedo. When asked by the AP, yes or no, whether he'll compete at the next Olympics, Phelps now says he hasn't planned that far ahead in his life.

That's a striking change from his comments before and immediately after the London Games, when he insisted his retirement was set in stone and it had always been his goal to quit swimming before he tuned 30.

Phelps will be 31 at the time of the opening ceremony for the Rio Games.

"I don't know. We're in 2013," he said, while adding, "There's nothing in the works."

There's plenty of time for a comeback. Phelps would likely want to begin training before the end of the year, which would allow him to get into peak condition leading up to the next world championships in 2015, an important steppingstone for the Olympics.

Phelps certainly isn't training at the moment. He jammed the small toe of his right foot on the edge of a sofa while at home in Baltimore, and aggravated the injury when he played in a golf tournament at Lake Tahoe.

He's wearing a boot cast on his foot while in Barcelona.

After some sightseeing and promotional appearances, Phelps took in a second night of swimming at the Palau Sant Jordi before heading back to the U.S. on Tuesday. He's accompanied by his new girlfriend, Golf Channel reporter Win McMurry.

Phelps was still seething about the U.S. loss in the 400-meter freestyle relay on Sunday. The American were edged at the finish by the French, a repeat of last summer's Olympics when a team that included Phelps also settled for silver.

He said the Americans should have gone with a different lineup, using Jimmy Feigen in the leadoff spot and Nathan Adrian as the anchor. Instead, Adrian went first and Feigen took over for the finish despite being the least experienced member of the U.S. foursome.

"We should never lose that race," Phelps said.

FORT MEADE, Md. (AP) ? Supporters of Army Pfc. Bradley Manning are demonstrating at Fort Meade as a military judge prepares to deliver her verdict in his court-martial.

About two dozen people wearing "truth" t-shirts waved signs Tuesday morning outside the Army installation near Baltimore. They proclaimed their admiration for the former intelligence analyst who sent reams of classified information to the anti-secrecy website WikiLeaks.

Twenty-three-year-old Joel Greenfield of Arcadia, Calif., says Manning exposed the truth about military and diplomatic wrongdoing and is now paying the price for it.

Manning could get life plus 154 years in prison if convicted of aiding the enemy and 20 other charges.

Forty-three-year-old Barbara Bridges of Baltimore says Manning gave people the information they need to hold their government accountable.

WASHINGTON (AP) ? The House is set to go along with a bipartisan Senate compromise that would link college students' interest rates to the financial markets and offer borrowers lower rates this fall.

The Senate bill hews closely to one the House already has passed, and leaders from both parties and in both chambers expect those differences won't stand in the way of quick resolution, perhaps as early as Wednesday.

House approval would send the measure to President Barack Obama, who has said he would sign it into law "right away."

But critics note that if the economy improves, as expected, rates could climb higher.

If the Republican-led House consents to the Senate's tinkering with the House's earlier proposal, and Obama signs the legislation before students start returning to campus, families would see better deals on some federal loans this year than they did in 2012. Undergraduates could borrow at rates as low as 3.4 percent for subsidized Stafford loans and 6.8 percent on unsubsidized Stafford loans last year, while graduate students and parents borrowed at 7.9 percent last year.

Those 3.4 percent rates doubled on July 1 because Congress did not act. Lawmakers from both parties said the rate increase was unacceptable and worked on various proposals to extend rates, overhaul rates and even remake the entire program before classes start this fall.

Both chambers would link the interest rate to the 10-year Treasury note plus an added percentage, based on the type of loan. Each sets caps on how high the loans can go.

But under the Senate bill, once a student or parent takes a loan for the school year the rate would not change. The House bill would make the interest rate variable, meaning it could change every year until the loan is repaid.

A look at what the House and Senate bills would mean for students and their parents:

UNDERGRADUATES:

Senate: Undergraduates who take subsidized and unsubsidized Stafford loans would pay the 10-year Treasury note, plus an additional 2.05 percent. That would put the interest rate at about 3.9 percent this fall. Rates would be capped at 8.25 percent.

House: Under the House bill, undergraduates who take subsidized and unsubsidized Stafford loans would pay the 10-year Treasury note, plus an additional 2.5 percent. That would translate to an interest rate of about 4.3 percent interest rates for loans taken this fall. Rates would be capped at 8.5 percent.

GRADUATE STUDENTS:

Senate: Graduate students would borrow at the interest rate of the 10-year Treasury notes plus an additional 3.6 percent. That would bring 5.4 percent interest rates for borrowers this fall. Rates would be capped at 9.5 percent.

House: Graduate students and parents would borrow at the 10-year Treasury note plus an additional 4.5 percent. Under this formula, graduate student loans this fall would carry a 6.3 percent interest rate. Rates would be capped at 10.5 percent.

PARENTS AND SOME GRADUATE STUDENTS:

Senate: Parents and some graduate students would borrow at the 10-year Treasury note plus an additional 4.6 percent. That works out to a 6.4 percent interest rate for fall term. Rates would be capped at 10.5 percent.

House: Graduate students and parents would borrow at the 10-year Treasury note plus an additional 4.5 percent. That would bring about 6.3 percent interest rates for borrowers this fall. Rates would be capped at 10.5 percent

Brandt Snedeker wins Canadian Open

Snedeker closed with 2-under 70 for a three-stroke victory.

"Just ecstatic right now," Snedeker said. "This is a tournament I said early on in my career I wanted to win just because my caddie (Scott Vail) is actually from Canada and it's his national open. It meant a lot to him, meant a lot to me. Third-oldest tournament on tour and it's got some great history to it, and now to put my name on that trophy it means a lot."

Snedeker finished at 16-under 272. The six-time PGA Tour winner also won the Pebble Beach National Pro-Am in February.

"It feels great to get a win," Snedeker said. "To validate all the hard work I've put in over the past three months where I haven't played my best and know that I'm working on the right stuff and able to hold up under some pretty serious pressure this afternoon. To win a tournament like this with those pivotal holes coming down the stretch means a lot."

Snedeker had two birdies and a bogey on the front nine. He birdied the par-4 10th to move to 16 under, but gave the shot back on the par-3 12th. He birdied the par-5 16th and parred the final two holes.

"I hung in there really well and made the key putts I needed to and I was able to survive," Snedeker said. "That's what today is all about."

Dustin Johnson, William McGirt, Matt Kuchar and Jason Bohn tied for second.

Johnson was tied for the lead after a birdie on No. 16, then drove out of bounds and hit the lip of a fairway bunker en route to a triple-bogey 7 on the par-4 17th. He finished with a 70.

"I was playing really well," Johnson said. "Really confident, swinging the driver really good. So you know, it's a driver hole for me, and I just blocked it a little bit. Made a poor swing. ... Not too happy, but I felt really good with my golf game. ... It's nothing, nothing to worry about. I'll go get them next weekend."

McGirt had a 68, and Kuchar and Bohn shot 71.

David Hearn was the top Canadian, shooting a 73 to tie for 44th at 4 under.

"It wasn't the finish that I was really looking for. I had a nice chance today," said Hearn, a playoff loser in the John Deere Classic. "I'll take away some positives from the week. I appreciate the support from everyone here this week and it always feels good to play at home."

Mike Weir tied for 49th at 3 under after a 72.

"I'm playing fine. Just missing too many short putts," Weir said. "I missed a number the last couple days inside 6, 7 feet, just missing way too many of those. You need those to keep your round going sometimes and I just didn't capitalize when I had opportunities."

Pat Fletcher, born in England, was the last Canadian winner, taking the 1954 event at Point Grey in Vancouver. Carl Keffer is the only Canadian-born champion, winning in 1909 and 1914. Albert Murray, a Canadian also born in England, won in 1908 and 1913.

PHILADELPHIA (AP) ? Six-time Pro Bowl quarterback Donovan McNabb will officially retire a member of the Philadelphia Eagles on Monday.

McNabb played 11 of his 13 seasons with the Eagles, leading them to eight playoff appearances, five NFC East titles, five conference championship games and one Super Bowl loss.

The 36-year-old McNabb hasn't played in the NFL since 2011. He was traded to Washington in 2010, started 13 games for the Redskins that season and six for Minnesota the following year.

The father, who grew up in South Boston, remembered telling the suburban parents how the neighborhood has changed, attracting ever more young professionals like their kids who?d take the bus downtown to their first post-college jobs.

And the parents, including the Lords, felt good about the safety of the apartment building, the father said. It?s a free-standing building with Yoberry Frozen Yogurt on the first floor. The Junction, with its $11 build-your-own-burgers and Tuesday trivia nights, is next door. It?s just a block from South Boston?s busiest street, West Broadway, where new arrivals carried yoga mats yesterday and ate lunch open-air at Lincoln Tavern, with its tiled floors and tin ceilings.

?Scituate North,? the Wayland father said, is a nickname now for South Boston: so close to the water and a rebuilt waterfront. He does not blame his hometown. ?This could happen anywhere. It just happened in Wayland,? he said, referring to the 2011 murder of Lauren Astley by her ex-boyfriend.

?It?s just so immensely sad what happened. I?m not a big fan of three strikes and out,? he said of a law that requires the maximum sentence for three-time violent criminals. ?But I am a big fan of 10 strikes and out,? he said, referring to Edwin Alemany?s long, violent record. ?And I am livid that somebody let this (guy) slide,? said the father as he filled up his big SUV, and took his daughter home.
