Penn State president: 'We are committed to addressing our failings'

DUNMORE, Lackawanna County ? A day after a scathing report revealed a cover-up of child sexual abuse at Penn State, officials at the university vowed to promptly address the report's recommendations and reconsider the university's "leadership culture."

University President Rodney A. Erickson, during a board of trustees meeting at the university's Worthington campus here, said he has appointed a team of three top university officials to coordinate operational changes recommended by special investigator Louis Freeh's 267-page report.

"We are committed to addressing our failings," Erickson said.

While adding that it will take time to review the report and its recommendations, "it has become clear to me that we need to reconsider our community's leadership culture," he said.

Meanwhile, Karen Peetz, the board's chairwoman, reiterated that her board "accepts full responsibility for each of the failures that occurred in cooperation with the administration."

She said board committees at a September meeting are expected to present "action plans" after reviewing portions of Freeh's report that pertain to their function on the board. She expects the board to adopt most, if not all of the 119 recommendations in the report.

"We will take every action to ensure events like these never happen again," Peetz said.

Later, during a news conference, university officials said it's too early to say what the future holds for the statue of former football coach Joe Paterno at the university and the use of his name and likeness. Peetz, responding to a question, referred to that as a "sensitive issue," saying it would take a "lot of deliberation and discussion."

In a report released Thursday on the Jerry Sandusky sex-abuse scandal, Freeh, a former head of the FBI, said Paterno and top Penn State administrators covered up child sex-abuse allegations against Sandusky for more than a decade to protect the university.

His report also slammed the board of trustees for failing to perform its oversight duties.

University President Graham Spanier resigned in the wake of the scandal. Vice President for Finance and Business Gary Schultz and Athletic Director Tim Curley face trial for allegedly lying to a grand jury.

Without mentioning any of the men by name, Peetz said, "It's sufficient to say that the investigation concluded that certain people at the university in a position to protect children ? failed to do so."

The Freeh team's findings could have serious consequences for the university, which faces civil lawsuits by some of Sandusky's victims, an NCAA investigation of how the Penn State football program was managed, and charges against Schultz and Curley of failing to report a crime. Erickson said he would be in contact with the NCAA in the next two weeks.

The university has been named in three civil lawsuits related to the Sandusky scandal at U.S. District Court. None of three plaintiffs were among the victims in the grand jury report on charges against Sandusky, according to trustee Ira Lubert, who said he expects additional suits to be filed.

He said former assistant coach Mike McQueary has filed court papers outlining his plans to file a whistle-blower lawsuit, adding that "we don't believe Mr. McQueary's claims have any merit."

In February 2001, McQueary saw Sandusky in a locker room shower with a boy and reported it to Paterno.

Meanwhile, the board began implementing a number of changes, which included lowering trustee term limits from 15 years to 12 years beginning next year and starting a 30-minute public comment period at meetings.

The board also appointed a new vice president and general counsel ? Stephen Dunham ? and announced that a search is under way for a new chief compliance officer.

In addition, the university will hire a new coordinator of the Jeanne Clery Disclosure of Campus Security Police and Campus Crime Statistics Act and provide related training. The act was named for Jeanne Clery, a 19-year-old Lehigh University freshman who was raped and murdered in 1986 in her dorm room.

Freeh's report noted that top officials, including Paterno, were obligated under the Clery Act to report the shower incident to the university police department.

"I'm not a good mimic, to be honest. I don't do good impressions," said Gordon-Levitt, who also co-stars in next week's Batman finale "The Dark Knight Rises." ''I didn't think an impersonation would be appropriate, anyway. It would just be distracting. So I just tried to internalize and do something that made sense to me. ...

"The most I learned from him is just hanging out with him," Gordon-Levitt said. "He's a sweetheart and he loved this job. He was clearly there to play."

The movie opens Sept. 28.

CAIRO (AP) ? The Egyptian Bedouin who abducted two Boston natives and their guide on Friday vowed he would take more hostages of different nationalities if police do not release his uncle from prison.

Speaking to The Associated Press by telephone, Jirmy Abu-Masuh of the Tarbeen tribe in Egypt's Sinai Peninsula, said the captives would remain safe, but that more would be abducted if his uncle is not released.

"If my uncle gets 50 years (in prison), they will stay with me for 50 years. If they release him, I will release them," he said of the captives. "Tomorrow I will kidnap other nationalities and their embassies will be notified for the whole world to know."

Abu-Masuh, a 32 year-old truck driver, said the American man, 61, and woman, 39, were treated as "guests" and given tea, coffee and a traditional lamb dinner reserved for special occasions in Bedouin culture. He said that the man is a pastor from Massachusetts and that he had been allowed to call his wife.a

"I told them 'nothing will happen to you. You are my guest'," he said.

The two Americans could not be immediately reached for comment. Abu-Masuh said they were asleep in his home located deep in central Sinai's rugged mountains.

The two Americans were abducted in broad daylight when Abu-Masuh stopped the tour bus they were in with dozens of other tourists along a major road linking Cairo to the sixth-century St. Catherine's Monastery, located at the foot of Mount Sinai where the Old Testament says Moses received the stone tablets with the Ten Commandments. The route to the monastery is a frequent target by Bedouins who abduct tourists to pressure police to meet their demands, which is usually to release of a detained relative they say has been unjustly arrested.

They were allowed to bring their Egyptian tour guide with them.

Abu-Masuh said he wants police to release his 62 year-old uncle, who he said suffers from back and heart problems and diabetes. He said his uncle was arrested Sunday on his way to the northern coastal city of Alexandria after refusing to pay a nearly 100 dollar bribe to police who stopped him along the way. The story could not immediately verified.

"These police are the same traitors of the Mubarak regime. Nothing has changed," he said, referring to ousted leader Hosni Mubarak's widely-mistrusted security forces. Mubarak was toppled in a popular uprising last year partly fueled by anger at police brutality and corruption.

"I hate the security forces and honestly they made me hate being Egyptian too," he said.

Bedouins in Sinai, a region that borders the Gaza Strip and Israel, have long complained of state discrimination against them. They say they are never given high-level posts in the military and frequently harassed by police. Many are unemployed and some turn to cross-border smuggling of people and weapons for survival.

Security officials said Friday they were working on releasing Abu-Masuh's uncle. They spoke on condition of anonymity in line with regulations.

Abu-Masuh said that Egypt's Prime Minister Kamal el-Ganzouri called him personally and asked him to release the Americans "who are guests in our country."

He said his uncle called him from prison pleading the same and fearing police might arrest his children or wife to pressure Abu-Masuh.

The trouble with being such a strong "J" and having children is that children have needs that don't always fit neatly into a schedule. ?One area of growth I have experienced since becoming a mother is learning how to be flexible. ?It's difficult to have a daily schedule when you have babies and toddlers. ?I understand that very well, so I in this post I will share?separate?tips for mothers of younger children and mothers of older children.

For moms of children under the age of seven, here are my tips for creating a daily schedule.

Focus more on having a routine than following a schedule. ?Children are comforted by routine. A schedule may work for two days until your baby hits a growth spurt and needs to nurse constantly or your toddler gets sick and refuses to sleep. ?
Plan your days so that one thing usually follows the other and keep it?consistent. ?
Keep meal times as consistent as possible for toddlers.
Have a solid bedtime routine, even if you co-sleep.
Relax about the housework. ?Your house isn't suppose to be perfect when you have small children. ?Even if it was perfect, it wouldn't be that way for long. ?Shoot for one chore per day that is not dishes or laundry. ?If all you can do in a day is dishes and laundry, then just do dishes and laundry!
Make weekly (or monthly if you are an ambitious mama!) meal plans! ?Yes. ?Do it. ?Love it. ?Okay, you don't have to love it, but do it anyway.
Plan one or two "errand days" per week and limit errands to those days. ?Leaving the house five out of seven days per week makes you feel like an In-The-Car mom instead of a Stay-At-Home mom!

Giving ancient life another chance to evolve: Scientists place 500-million-year-old gene in modern organism

ScienceDaily (July 11, 2012) ? It's a project 500 million years in the making. Only this time, instead of playing on a movie screen in Jurassic Park, it's happening in a lab at the Georgia Institute of Technology.

Using a process called paleo-experimental evolution, Georgia Tech researchers have resurrected a 500-million-year-old gene from bacteria and inserted it into modern-day Escherichia coli (E. coli) bacteria. This bacterium has now been growing for more than 1,000 generations, giving the scientists a front row seat to observe evolution in action.

"This is as close as we can get to rewinding and replaying the molecular tape of life," said scientist Bet?l Ka?ar, a NASA astrobiology postdoctoral fellow in Georgia Tech's NASA Center for Ribosomal Origins and Evolution. "The ability to observe an ancient gene in a modern organism as it evolves within a modern cell allows us to see whether the evolutionary trajectory once taken will repeat itself or whether a life will adapt following a different path."

In 2008, Ka?ar's postdoctoral advisor, Associate Professor of Biology Eric Gaucher, successfully determined the ancient genetic sequence of Elongation Factor-Tu (EF-Tu), an essential protein in E. coli. EFs are one of the most abundant proteins in bacteria, found in all known cellular life and required for bacteria to survive. That vital role made it a perfect protein for the scientists to answer questions about evolution.

After achieving the difficult task of placing the ancient gene in the correct chromosomal order and position in place of the modern gene within E. coli, Ka?ar produced eight identical bacterial strains and allowed "ancient life" to re-evolve. This chimeric bacteria composed of both modern and ancient genes survived, but grew about two times slower than its counterpart composed of only modern genes.

"The altered organism wasn't as healthy or fit as its modern-day version, at least initially," said Gaucher, "and this created a perfect scenario that would allow the altered organism to adapt and become more fit as it accumulated mutations with each passing day."

The growth rate eventually increased and, after the first 500 generations, the scientists sequenced the genomes of all eight lineages to determine how the bacteria adapted. Not only did the fitness levels increase to nearly modern-day levels, but also some of the altered lineages actually became healthier than their modern counterpart.

When the researchers looked closer, they noticed that every EF-Tu gene did not accumulate mutations. Instead, the modern proteins that interact with the ancient EF-Tu inside of the bacteria had mutated and these mutations were responsible for the rapid adaptation that increased the bacteria's fitness. In short, the ancient gene has not yet mutated to become more similar to its modern form, but rather, the bacteria found a new evolutionary trajectory to adapt.

The results were presented at the recent NASA International Astrobiology Science Conference. The scientists will continue to study new generations, waiting to see if the protein will follow its historical path or whether it will adopt via a novel path altogether.

"We think that this process will allow us to address several longstanding questions in evolutionary and molecular biology," said Ka?ar. "Among them, we want to know if an organism's history limits its future and if evolution always leads to a single, defined point or whether evolution has multiple solutions to a given problem."

Noisy union members gather outside NY utility HQ

NEW YORK (AP) ? With the heat pressing down on New Yorkers, pressure is mounting from all sides to resolve a Consolidated Edison lockout that left workers off their jobs while managers are keeping the electrical power going.

"Con Ed must end its lockout and allow the workers to return to their jobs while the new contract is negotiated," City Council Speaker Christine Quinn said in a statement Monday.

"When the power goes out and air conditioning and lights go off, it is often the most vulnerable such as the elderly and chronically ill that suffer with often serious consequences," the speaker said.

On Monday, union workers' tempers rose along with the heat on city streets.

"Kevin Burke, come out with your hands up, we want our pensions!" mechanic John Lucchini yelled into a bullhorn, naming Con Ed's CEO amid a protest in front of company headquarters.

Elsewhere in New York City, union leaders planned their next move following the breakdown of contract talks Sunday after a midnight deadline.

Both sides said there are many issues on which they have not reached agreement, including changing pension terms.

Con Ed offered workers a two-week extension, on condition they promise not to suddenly strike during that time. The union refused, and the utility declared a lockout, saying 8,500 workers would be replaced by 5,000 managers to keep services running.

A union spokesman said that sometime Monday, Harry Farrell, president of Local 1-2 of the Utility Workers of America, would call for federal mediators to intervene to get talks started again.

Union spokesman John Melia said Monday there was nothing new to report. He planned to issue a statement later in the day.

"We've been trying to get them back to the table since yesterday," company spokesman Mike Clendenin said Monday on "Good Morning New York."

The unionized workers told the company they'd be willing to work without a contract to keep the power company running, said Melia, who disputed the company's claim that its managers could do the job of the union workers.

A manager doing routine Con Ed work suffered minor burns, Con Ed confirmed.

Manhattan Borough President Scott Stringer issued a statement, saying Con Ed employees "deserve respect and a fair contract, and residents of the New York City region deserve assurances their power will continue without interruption as the heat wave continues."

He said both goals can be achieved "if we work together and settle this dispute amicably."

Another mechanic, Rick Brown, said there's nothing workers would like to do more than "than be on the clock."

But "the people who are doing the public an injustice are management," he said.

Brown was part of the noisy scene outside Con Ed headquarters near Union Square that included a chorus of honking, cheers and whistling heard a couple of blocks away. The honking was a show of support by drivers passing about 200 union demonstrators.

Many union workers wore T-shirts that said, "If we go out, the lights go out." They also featured a cracked, yellow light bulb with a red circle and slash.

Boos, catcalls and foul language erupted as management workers left the building.

Gregory Stephenson, a government relations employee at Con Ed who exited the company's corporate office to a loud chorus of boos, said he was disappointed by demonstrators' behavior.

"I understand the union's sentiment, but once you start to hurl abusive language ? I just think there needs to be a level of decorum and respect," he said.

Con Ed closed walk-in centers, suspended meter readings and limited work on major construction projects in New York after the talks broke down around 2 a.m. Sunday, a couple of hours after the existing contract expired. The impasse came as New York endured more high temperatures that increased demand for air conditioning among the utility's 3.2 million customers.

There were about 200 outages overnight, nearly all of which were resolved by morning, Con Ed spokesman Chris Olert said Monday. He said management personnel were standing by, ready to address any problems.

Temperatures are expected to be in the high 80s and low 90s throughout the week.

The extreme weather included vicious storms from Indiana to New Jersey and south to Virginia that left 17 people dead and 2.7 million without power. Most of the damage came in the mid-Atlantic region, and only scattered outages across Con Ed's service area in New York were reported as of Sunday. Con Ed said it is keeping a close watch on its system and has trained managers working on essential operations.

Barclays faces probe into rate-rigging scandal

Barclays Bank chairman Marcus Agius resigned on Monday over an interest rate rigging affair as the bank faced possible criminal prosecution in a scandal that has sullied London's image as a financial centre.

The beleaguered bank announced Agius' departure and promised an independent audit, amid wider questions about the future of chief executive Bob Diamond and the ethics of London's financial sector, the City.

Britain's Serious Fraud Office (SFO) said it was considering whether it was "appropriate and possible to bring criminal prosecutions" over the issue, adding that it hoped to reach a conclusion within a month.

Prime Minister David Cameron also announced a parliamentary inquiry into the revelations that Barclays traders had lied about the interest rates other banks were charging it for loans.

The scandal, which might implicate other international banks, concerns manipulation of the Libor and Euribor rates which play a key role in global markets, affecting what banks, businesses and individuals pay to borrow money.

Barclays said that Agius, who has chaired the bank for six years, would remain in his post until a successor was found.

"The buck stops with me," Agius said in his resignation statement, less than a week after the bank was fined ?290 million ($455 million, 360 million euros) by British and US regulators for attempted rigging.

"I am truly sorry that our customers, clients, employees and shareholders have been let down.

"Last week's events -- evidencing as they do unacceptable standards of behaviour within the bank -- have dealt a devastating blow to Barclays' reputation."

Barclays said it would launch an independent audit that would "undertake a root and branch review of all of the past practices that have been revealed as flawed since the credit crisis started" about five years ago.

The bank insisted that it would establish "a zero tolerance policy for any actions that harm the reputation of the bank."

The SFO said on Monday that it had been working closely with the Financial Services Authority watchdog during the latter's investigation into Libor rate manipulation.

"Now that the investigation into the issue of regulatory misbehaviour has concluded, the SFO are considering whether it is both appropriate and possible to bring criminal prosecutions," the office said.

Cameron, meanwhile, told parliament there would be a full parliamentary inquiry into the scandal which would get to work "immediately".

"This committee will be able to take evidence under oath," he said.

"It will have full access to papers, officials and ministers, including ministers and special advisers from the last government."

Cameron said Britons wanted "to see bankers who acted improperly punished, and they want to know we will learn the broader lessons of what happened in this particular scandal."

The bank's share price nonetheless jumped 3.22 percent on Monday to close at 168.10 pence on the benchmark FTSE 100 index, which was up 1.25 percent.

The gains helped the bank's share price to recover from last week's heavy losses that wiped billions of pounds from Barclays' market value.

"Investors seemed to view the resignation of its chairman as a step in the right direction after the LIBOR scandal broke last week," said David Jones, chief market strategist at IG Index.

But there was continued speculation over whether Diamond, a high-profile and highly paid banker, would keep his job amid widespread calls for him to go.

US national Diamond, who was in charge of Barclays' investment arm at the time of the suspected manipulation, is to face questions from British lawmakers on Wednesday.

Markets were also wondering whether the latest banking scandal would result in a radical shake-up of the way in which business is conducted across the City, amid pressure from high up the political ladder.

"We need to take action right across the board," Cameron said as he announced the parliamentary inquiry into rate-rigging.

"Introducing the toughest and most transparent rules on pay and bonuses of any major financial centre in the world, increasing the taxes banks must pay," he said.

"Ensuring tough civil and criminal penalties for those who break the law. And above all, clearing up the regulatory failure left by the last Labour government."

Barclays is the first major financial institution to settle following investigations on both sides of the Atlantic.

On Sunday it emerged that bailed-out Royal Bank of Scotland (RBS) had sacked four traders over their alleged involvement in the affair, raising suspicions that the practice was widespread.

TOKYO (AP) ? A powerful politician and dozens of his followers quit Japan's ruling party on Monday and are likely to form their own rival bloc, dealing a blow to Prime Minister Yoshihiko Noda.

Ichiro Ozawa and 49 other lawmakers submitted their resignations to the Democratic Party of Japan, and others could follow later, party officials said. Thirty-eight are members of the lower house of Parliament, where a loss of 11 more seats would end the ruling party's majority and could force Noda to call new elections.

Ozawa, 70, played a key role in the party's rise to power in 2009, defeating the long-ruling Liberal Democratic Party. He has been a vocal critic of Noda's plan to double Japan's sales tax to 10 percent by 2015.

The tax hike has passed the lower house and is expected to be approved by the less-powerful upper house since it has the backing of the two largest opposition parties.

Ozawa said the ruling party has "betrayed" the public by teaming up with the opposition to ram through the tax hike.

"The Democratic Party under Prime Minister Noda is no longer the one that achieved a power change," Ozawa told a news conference. "We are looking at forming a new party in order to return to our initial principle of establishing a political system in which the people can have a choice."

Ozawa declined to give further details about the new grouping, but said it would focus on addressing the people's main concerns, such as nuclear safety, in addition to opposing the tax increase. He said a decision on policies and other details of a new party would be announced in a few days.

The party split will make it harder for Noda to achieve his policy goals in Parliament.

Noda, who has been in office only since September, has made the tax hike the centerpiece of his efforts to finance government programs as Japan's population rapidly ages. Opponents say a higher sales tax would hurt the economy, which was hit hard by last year's devastating earthquake and tsunami and has been sputtering for years under one of the largest public debt burdens in the developed world.

"It's a reform to protect the livelihood of the people and future generations," Noda said of the tax increase. "We must pass the bill, and my responsibility is to make that happen."

Ozawa is unpopular with many voters and is seen as an old-style, wheeling-and-dealing "shadow shogun." However, he continues to have a loyal core of supporters, many of them younger politicians whose careers he helped launch.

Also known as "the destroyer," he has repeatedly split and created new political groups since he bolted from the Liberal Democrats with 43 fellow members in 1993. He merged his faction with the Democratic Party in 2003.

But this time, only about half of the members of his faction are leaving the ruling party, which analysts said could indicate Ozawa's waning influence.

"Ozawa's group is rather thin and weak," said Yoshimi Watanabe, head of a small opposition group. He said Ozawa's departure could free up the ruling party to pursue policies that he had opposed, and perhaps allow it to cooperate more with opposition parties.
